Who is obliged to pay property tax

You can download the Letter of the Tax and Duties Ministry of the Republic of Belarus from 01.02.2013. No. 2-2-13-13303 on our website. It clarifies who in the chain Owner-Tenant or Owner-Tenant-Subtenant is obliged to pay property tax.

We will consider the most popular scenarios in relation to the lease of a legal address.

  • If the owner of the premises is an Individual Entrepreneur, and the tenant is an Organization, then in this case the obligation to pay property tax falls on the Organization (regardless of the applicable tax system).
  • If an owner is an Organization and a tenant is an Organization, then the owner of the premises will be the payer of property tax.
  • If an Owner is an Individual entrepreneur, a tenant is an Individual entrepreneur, a subtenant is an Organization, then a property owner has the status of a taxpayer.

Besides, we draw your attention to the change in the Tax Code, which entered into force on 01.04.2015. This change in the Owner-Tenant-Subtenant chain obliges an intermediary (a Tenant) to apply the General tax system, regardless of the form of ownership.

Payment under the contract is made at the exchange rate of the National Bank of the Republic of Belarus on the day the payment is rendered. We work without VAT.
